These Terms and Conditions (“Terms”) govern your access to and use of
tributaryhedge.com (the “Site”), including any signal provision, copy trading facilitation,
features, content, and applications offered by Tributary Hedge (Pty) Ltd (“we,” “us,” or “our”),
a company registered in the Republic of South Africa. By accessing or using the Site, registering an account,
or subscribing to our trading signals, you agree to be bound by these Terms. If you do not agree, do not use
the Site.

1. Acceptance of Terms

These Terms form a legally binding agreement between you and Tributary Hedge (Pty) Ltd. We may update these
Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
We will notify you of material changes via the Site or email.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. You represent
that you have the legal capacity to enter into these Terms. Certain services may be restricted based on your
location due to applicable laws, including those enforced by the Financial Sector Conduct Authority (FSCA) in
South Africa.

3. Account Registration

To access signal subscriptions or leader/follower features, you must create an account with accurate
information. You are responsible for maintaining the confidentiality of your account credentials and for all
activities under your account. Notify us immediately of any unauthorized use.

4. Description of Services

Tributary Hedge provides trading signals and facilitates copy trading through third-party services.

• Users (“Followers”) may subscribe to signals generated by selected signal providers (“Leaders” or “Master
  Traders”).
• Followers connect and apply these signals to their own brokerage accounts using independent third-party copy
  trading tools or services (e.g., trade copiers, signal aggregators).
• We do not host, manage, or execute trades on any platform. All trading occurs exclusively in your own forex
  broker account via the third-party service you choose.
• We act solely as a signal provider and facilitator on an execution-only basis and do not provide investment
  advice.
• All services comply with applicable South African regulations, including those under the Financial Advisory
  and Intermediary Services Act (FAIS Act).

5. Copy Trading and Signal Subscription Specific Terms

• Signal Delivery: Signals are provided for informational purposes and delivered via the Site, email, or integrated third-party services.
• Third-Party Execution: You are solely responsible for selecting and configuring any third-party copy trading service to replicate signals in your own broker account. We do not control, endorse, or guarantee these third-party services.
• Differences in Performance: Your actual trading results may differ significantly from the Leader’s displayed performance due to third-party service delays, slippage, broker spreads/commissions, leverage differences, account settings, or market conditions.
• Leader Selection: You are solely responsible for choosing which Leaders’ signals to subscribe to or follow. Past performance is not indicative of future results.
• No Automated Execution by Us: We do not automatically execute or copy trades in your account.

6. Fees and Payments

• Subscription fees for access to signals, performance fees (shared with Leaders), or other charges may apply.
• Fees are billed through our payment processors and are non-refundable except where required by law.
• Leader compensation (e.g., profit-sharing) is outlined in their profile and may be facilitated separately if applicable.

7. Risks and Disclaimers

Trading financial instruments (including forex, CFDs, cryptocurrencies, stocks) involves high risk of loss,
potentially exceeding your deposits due to leverage and volatility.

• No Guarantees: We do not guarantee profits or protection from losses.
• No Advice: Signals and information on the Site are for informational purposes only and not investment advice.
• Third-Party Risks: We are not responsible for issues arising from third-party copy trading services, brokers, or tools, including delays, errors, or failures.
• Leader Risks: Leaders may change strategies, incur losses, or cease providing signals without notice.

You should only trade with funds you can afford to lose. Seek independent advice if needed. We operate in
compliance with FSCA requirements.

8. User Responsibilities

• Comply with all applicable laws and regulations, including South African financial sector laws.
• Do not engage in manipulative, abusive, or fraudulent trading.
• Provide accurate information and update as necessary.
• You are responsible for taxes on any profits, including in terms of South African tax laws.
• Ensure your chosen broker and third-party services comply with applicable regulations.

9. Intellectual Property

All content on the Site (including software, designs, trademarks, signals) is owned by Tributary Hedge (Pty)
Ltd or our licensors. You are granted a limited, non-transferable license to use the Site and signals for
personal trading purposes only. No copying, redistribution, or commercial use without permission.

10. Prohibited Activities

You may not:

• Use the Site or signals for illegal purposes.
• Interfere with or disrupt the Site.
• Reverse engineer or access source code.
• Share accounts or impersonate others.
• Redistribute or sell our signals.

We may suspend or terminate accounts for violations.

11. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any losses from trading, signal usage, third-party services, or Site use.
• Our liability is limited to direct damages and capped at fees paid by you in the prior 12 months.
• No liability for indirect, consequential, or punitive damages. Services are provided “as is” without warranties.

12. Indemnification

You agree to indemnify us against claims arising from your use of the Site, signals, third-party services,
violations of these Terms, or trading activities.

13. Termination

We may terminate or suspend your access at any time, with or without cause. Upon termination, your access to
signals will cease immediately.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved
exclusively in the courts of the Republic of South Africa.

15. Miscellaneous

• Severability: Invalid provisions do not affect others.
• No Waiver: Failure to enforce does not waive rights.
• Assignment: We may assign these Terms; you may not without consent.
• Entire Agreement: These Terms supersede prior agreements.
